Terms and Conditions

Welcome to ITSOFT-BD! By utilizing our services, you acknowledge and agree to adhere to the following Terms and Conditions. We encourage you to read them thoroughly to ensure a transparent professional relationship.

1. Our Work Schedule

• We operate 5 days a week (45 hours total), excluding government holidays. Our office remains closed on all public holidays in Bangladesh.
• Project timelines commence from the date payment is received. In cases where contract signing and payment occur on different dates, the payment received date is considered "Day 0".

2. Payment & Refund Policy

• Refund Policy: We maintain a strict refund policy. Refund requests are only entertained prior to the commencement of structural or architectural work. Once development has started, no refunds will be issued.
• To initiate a refund, clients must submit a formal Refund Request Form before development begins.
• Any modifications requested after the agreement is signed will require a supplementary agreement and updated billing.

3. Service Delivery & Modifications

• We execute projects based on the pre-agreed plan outlined in the official work order.
• Any new revisions, alterations, or amendments post-agreement will necessitate a new work order and additional billing.

4. Intellectual Property Rights

• Upon full settlement of all outstanding payments, ownership of the copyright and legal rights for the completed work will be transferred to the client.
• ITSOFT-BD retains the right to showcase the project in our professional portfolio unless a non-disclosure agreement (NDA) or confidentiality clause is explicitly requested by the client.

5. Ethical & Legal Compliance

• We strictly decline projects that violate the Bangladesh Government's Information Technology policies, international standardization protocols, or ethical social standards.
• For specific cybersecurity services, a police GD (General Diary) copy may be required depending on the nature and complexity of the task.

6. Limitation of Liability

ITSOFT-BD shall not be held liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, profits, or business opportunities, arising from the use of or inability to use our services.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Bangladesh. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.
