1. Our Work Schedule
- We work 5 days a week (45 hours), without the government holidays. Our office does not work on government holidays.
- The days we will be working for you, we shall begin counting from the day we get our payment. When the contract signing and payment dates are different, we consider the payment received date as "Day 0" and work will start then.
2. Payment & Refund Policy
- Refund Policy: We have a firm refund policy in place. Refund requests are only accepted prior to the start of the structural work. If we have already started the development, no refunds will be issued.
- The client has to announce a refund to us before any development work is started to request a refund and fill in the Refund Request Form.
- If any changes are requested after signing the agreement, a new agreement and billing will be assigned.
3. Service Delivery & Modifications
- Following the no disfiguration of the contract, we will continue with our pre-agreed plan that was listed in the work order.
- Any new revisions, alternations, or amendments will need a new agreement and a billing statement. We don't accept any of the new changes if there isn't any agreement about this type of work.
4. Cybersecurity and Legal Requirements
- For some kinds of cybersecurity services, getting a police GD (General Diary) copy might become relevant depending on how complicated the task is. Note that this is not required for all of the cyber-security work out there.
5. Legal and Ethical Considerations
- We abrogate ourselves from any tasks that entail the breaching of Bangladesh government's information technology policies, adherence to international standardization policies, and the ethical standards of human, social, and cultural behavior respectively.
6. Intellectual Property
- After the client pays the full amount, the ownership of the work done by us that contains the copyright and other legal rights will be given or transferred to the client, unless it is said otherwise. We still have the right to use the project as a part of our portfolio unless the client asks for confidentiality.
7. Limitation of Liability
- In such a case, IT SOFT will not be liable for any indirect, special, incidental, or consequential damages caused by the use of or the inability to use the services, including but not limited to lost data, profits, or business opportunities.
8. Privacy & Confidentiality
- We respect your privacy. The information you provide with us is being held confidentially and will be used only to successfully deliver the service you have been engaged for.
- Our Privacy Policy provides information on the methods of collecting, using and protecting your data.
9. Changes to Terms and Conditions
- IT SOFT has the exclusive right to make changes to these terms at any time. If we are to do so, the revamped version with a new effective date will be posted on our website. When you continue to avail of our services, you are agreeable to the new terms of service.
10. Governing Law
- The terms and conditions apply under the laws of Bangladesh, and any argument will be heard in the proper law courts in Dhaka, Bangladesh.
